Man misses a flight, while railways paid him 30,000 Rs.

   According to Supreme Court, railways was failed to explain that how and why the train was delayed. And it was liable to compensate 30,000 Rs to the man who misses his flight because of this incident.


Both the judges, Aniruddha Bose and MR Shah asserted that, whenever railways will fail to clarify such thoe of incidents, it would be legally liable to repay those passengers if they file a "Deficiency of service complaint". before a consumer forum.


As per the court declared, if railways wants to grow, they should look at their public transportation whether it is in good situation or ae they still surviving. If they want to contend with the private companies, they have to improve the system and their working community. It was said by the court because, observing the passengers time is valuable so someone has to take the commitment and must be held accountable for train delays.


Complaint was filed by Sanjay Shukla and his family for missing the scheduled flight at 12 noon from Jammu to srinagar after the train. It was scheduled at 8:10am at Jammu, but it was delayed by four hours, the incident was happened on 11th June 2016.


There was no chance to catch the flight, Sanjay shukla and his family had to take taxi to travel Jammu to Srinagar. It was charged Rs. 25000 indcluding the charge of lodging at Srinagar.


According to the Additional Solicitor General, Aishwarya Bhati, Rule no. 114 and 115 of Indian Railways conference association coaching Tariff No. 26 Part-1, should not be any type of liability of the Indian Railways to compensate for delays. But still, the supreme court gave the allowance of Rs. 30,000 with 9% of interest to Sanjay Shukla.
